Hi everyone, I applied for H1B last year and my employer said my application was not selected in lottery. This year a different employer is applying for my H1 and the lawyer today told me that I already have an approval and gave me a receipt no. When I checked its status online, its - 'Approval notice sent on 29th August 2007'.
I wonder how this lawyer is saying this is my approval, eventhough I was told by my employer last year that I didn't made through lottery. And now this lawyer is asking for the copy of that approval which I am not at all aware of. If I knew I already have the approval I wouldn't be applying again this year.
How did this lawyer found out about my approval receipt? Is there a provision for them to check? Will it be illegal if my application goes again, with an existing approval. I have never been to USA.
Please suggest, what should I do.

I have seen references that if there are different I-140 apps approved per family, there is a possibility of going for the 485 stage separately. Also I have seen posts stating that one can go for AOS and the other for CP.
How do you communicate to USCIS that for one you are doing AOS and the other you are doing CP, with reference to the 485 stage? When does this really happen?

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

It is a travesty that the fates of some 35 million Americans who need food aid are tied to the farm bill, which comes up every five years. The House passed an inadequate version last summer, and the Senate has failed to advance its own. It is time to ask why feeding the hungry must include a trough for multibillion-dollar agribusiness.
As it has pressed to keep its subsidies, about $26 billion in the current bill, agribusiness has contributed $415 million to federal political campaigns since 1990, according to the Center for Responsive Politics. The hungry don’t have much of a lobby. But those who cannot consistently put food on the table need the help promised in the bill, including more than $4 billion in improvements in the food stamp program and for emergency assistance. If the aid remains in the farm bill, and if it remains in a logjam, aid would continue at current, inadequate levels.
Food stamps regularly help 26 million people get something to eat. But the previous farm bill did not peg benefits to inflation, so as food prices have skyrocketed, families who were just barely getting by are now in a much worse place. Some 800,000 food stamp recipients — disproportionately elderly or disabled — are being told to make due on a minimum benefit of $10 per month. That amount has remained unchanged in 30 years.
As The Times recently reported, food banks and soup kitchens across the nation are being depleted by demand so overwhelming that the needy are being turned away, or given help so minimal, it is hardly worth the energy expended to get it.
Washington needs to do better. The Senate could start by rallying around the sensible legislation sponsored by Senators Frank Lautenberg, Democrat of New Jersey, and Richard Lugar, Republican of Indiana. It would replace crop supports with an insurance program to cover actual losses, and put the savings, potentially billions of dollars, to better use, including for food aid.
Or the Congress could make a bold statement and begin to restructure funding. It could get money to food banks faster if it came out of any bill but the farm bill.
The Bush administration has correctly opposed the excesses of the farm subsidies program, but it could do more. It could finance additional and immediate food assistance by dipping deeper into money culled from customs receipts to support farm and nutrition programs.
Since their beginnings, hunger relief and nutrition programs have been inextricably tied to helping farmers. That may have made sense once. But as recent maneuvers on the farm bill have shown, it no longer works.

I think you need to reapply for H1 again (unless you are transferring your visa category to H4).

I have an approved 140 with Sept 2005 PD
I have an I 140 and I 485 filed with Dec 2006. There is an RFE on this. I want to interfile I 485 with the approved I 140. Is there a possibility and if so what needs to be done.
I have submitted the response to the I 140 RFE. May be I will get a response in 2-4 weeks.
However, if the I 140 gets denied can I still Interfile my 485 with ealrier approved 140?
What are the options open for me to keep my 485 alive?

I sent the applications(I-140,I-485,I-131,I-765)to Nebraska center 3 weeks ago and it was received by them on December 17,2007(because I tracked the FedEx package).Until today,no receipts yet and my checks are not cashed yet and the receipting update says Current for Nebraska, is the normal or there is something wrong?

It depends. It may become 'U" but if your application is already 'pre-allocated a visa' during June, then you may still get some news in July.

Or maybe there's some pretty rational thinking behind SB1070 and eliminating rights for American born citizens of Hispanic descent. 30% of Arizonans are Hispanic. 42% of all students from kindergarten through twelth grade are Hispanic and the percentage goes even higher for the younger grades. Even if the efforts don't stand up to constitutional muster, maybe the real goal is not to get rid of illegal present immigrants, but, rather, all Hispanics, whether they are legal immigrants, born in the US or illegally present. My friends wife applied for h1b and left for India on march 30th, while on H4, they got their h4 stamped april 5th, and still dont know about status of h1b application. The i94 number mentioned in the I129 is the old I94 which was surrendered at port of exit. When they reenter sometime in may, she will get new I94 , which will of course, be valid exactly as the I94 mentioned on I129.
1. Will there be any other problem in port of entry , as she will be entering on H4 stamping.

I had already gotten my USDOS approval and my USCIS approval for my J waiver. The whole process took less than a month which surprised us! But it was stated on the I-797 that I should start working for my employer within 90days from March 19, which will be June 19. The problem is my training program does not end until June 30. Even if I wait until June 19 to file for my H1B, and if I don't go for premium processing, once they approve it and retro-date it, there will be an overlap from June 19-30. Can I apply for the H1 on June 30 instead (when my J expires) but that will be more than 90 days from March 19? I will appreciate any suggestions. Thanks!

I got an email from USCIS saying my I-485 case is now transferred to National Benefits Centre and is now pending standard processing at a USCIS office.
I am travelling to India currently and plan to re-enter on AP.
I wanted to know if
1. anyone has any ideas as to what this really means, anyone received similar email, experiences?
My priority date is not current so are they pre-adjudicating my case or planning to send a RFE??
2. Should I take any specific steps while re-entering on AP?

My I-140 was approved April 30,2007. The appoval letter indicated that not yet elligible for change of status. The I-485 was returned together with the checks we paid. Please clarify and what can I do next other than waiting?

Lou Dobbs said on Thursday he is considering career options including possible runs for the White House or U.S. Senate. Dobbs has drawn fire from Latino leaders and civil rights groups for frequent on-air remarks about U.S. border control and immigration that critics saw as demonizing illegal immigrants. I personally feel that even considering him for public office will be an insult to the American Public. Let's hope that his plans will remain a far away fiction.
