Guys,
I have been reading some posts since yesterday. I still haven't been able to get a confirmed clarification.
If I am on H1, and change my status on H4 for lets say 8 months. Then decide to start working again on H1, would I be counted against the cap again?
I have been reading some posts which says if I have been counted against the cap once in last 6 years, I won't be counted again. Does that apply when one changes visa status from H1 to H4, and then back to H1.
Has anybody done this successfully. Can you point to some clarification or law from USCIS itself?

Guys,
I need to find out what documents I need to send after I file I-765 online. DO anyone has the experience in this matter. I filed my I-485 and at tht time i did not filed my I756 just to avoid lawyer's fee.
The form says I need to send a copy of I-94 and photo thats all, but the confirmation notice I received after filing the form online said that do not send any photo's or any identification document and the notice said that they will sent me a Biometric appointment.
DO anyone has info on this

my wife and i went to renew our DLs.
i am on EAD and my wife is on AOS(pending 485) and we both have AP valid till feb 2010.
i got a temporary DL and will get 1 year DL in the mail.
my wife got temp DL but will get DL till feb 2010 only (expiration of AP-I94). they wanted to see I-140 or I-130 alongwith I-485.
i emailed flhsmv.gov and they also say that now you must show 140 and dependent names in 485 application which most of us dont have.

I'd like to know can a dependent (not the prime applicant) on a pending 485 status, avail unemployment insurance, especially the extended benefits which are being given by Federal govt. to the states.

I had applied for GC through my husband s employer for EB1 category. Recently USCIS websites has updated on its site regarding our case that I485 has been approved but I765 has been denied. Currently we are on L1/L2 visa. Has anyone faced such a situation? And what does this signify?

Iam an H4 transferred to H1B. I am on H1B since one year. My pay is less than the one mentioned in LCA, but more than the prevailing wages. My job profile also includes some part of salary as comission, which I would get at the end of the year. This is apart from the salary Iam receiving right now (greater than the prevailing wage and less than LCA). Do I face any problem if I happen to go for H1B visa stamp. Could you also suggest me how to defend myself if I am asked the difference in the salary by visa officer. Thanking you all in advance.

You can enter all the data, save it and book your date as and when it becomes available. I did it recently for Chennai. But, if you do not book the date within one week of saving your forms, you have to enter the data once again. For Chennai, they normally open the dates 3-4 weeks in advance.

I fall in Schedule A which is going to retrogression begining Nov, 06.
I am on H4, meanwhile i just made it to file my I140, 485, 765 and AP concurenntly, hence will get my EAD, but no approved 485. My situation is I dont want to be with this employer for long for this is in upstate MI, where my spouse wont be able to continue the H1, hence we will be living seperate for sometime.
Now after my 140 approval and 485 pending for 6 months can i change the employer, I heard something with AC 21 you can. But what are the pros and cons with it.
Can my employer revoke the approved 140 after 6 months too.

There is no mandate about that....They can come back anytime before Aug 17 as long as their PD is on or before July 31st, 2007.....Since USCIS said it will not reject 485s without medicals, you can get the medicals done later and submit when they send you an RFE....However, make sure to keep all the applications filled in and ready for mailing except for the signatures and I-94 information of the returning individuals......

What are the best and low risk options to convert to H4 status. Please advice

She most likely is out-of-status for a long time (more than 6 months). Also she started/would start accruing illegal/unlawful presence from the day her I-94 expired/expires. Talk to a lawyer before doing anything.
