ICE officials have announced the break up of a major marriage fraud ring in Texas. According to ICE: A 72-year-old grandmother who operated a marriage fraud ring for decades was sentenced Sept. 23 to serve 44 months in federal prison. Priority date of old EB3 case: Jan 2003 (140 approved). Started new EB2 case (PD Feb 2007) without notifying uscis of old priority date. Now EB2 140/485 pending since three months. Can I get early EB2-140/485 approvals if I notify uscis of my old priority date now? I belong to "other charge-ability areas" group.

I think you can employ any one on 1090 on temporary basis(nanny or home improvement, reapir etc) , not employ by start a company. Ask a lawyer.

Would anyone of you know whether someone on H1B can go ahead and hire a US citizen and be their employer? I know some people do hire nannies. How about for other everyday occupations?

I filed in EB2 catagory through company A ( small size company )based on future employment
PD- Sep/04.
I-140- Pending.

I am currently working with company B ( Multinational ). My current status is 5th yr H1B ending in Oct 07..Current employer ( Company B ) has finally approved to file PERM labor..

I am struggling to decide if I should file I-485 with company A awail the current dates and at the same time continue to file PERM in next couple of months with company B..

Would it creat any legel wrangling later on?

I am already in my 5 th yr of h1B with company B and there is no guaranteed job opportunity with company A..

Appreciate if any one in the forum could help resolve my situation.

Hi All,

I'm looking for solutions in my situation.
I'm currently under a L1 visa for a company A but I would like to resign and look for another Job.

The thing is, as far as I understood, If I resign I have to leave the US. So here are my questions:

1) How long can I stay in the US after I resigned from my company under a L1 visa? Can I stay in the US even if my I-94 is valid?

2) How is the USCIS notified that I resigned from my company? Should I send a notification or is that done by my company?

3) Can I apply to a H1B COS by myself to then look for a job? Or will I need a company B to sponsor me?

4) If I can't apply to a H1B COS by myself, do I have any other visa options?

Hi

We (my wife and I) applied for our EAD renewals. I got email 2 days back saying 'Card production ordered', but did not get a similar mail for my wife.

Is it normal to have applicant and dependent's timings for approvals on different dates? I was thikinkg that since we applied on the same date, and since my case is renewed, my wife's should also be renewed at the same time. Can I wait more or is this something a cause of concern?

Any suggestions please

Company A filed my I-140 and it got approved, however I have not been provided with copy of the approval notice. I don't have the receipt number either. In this case, is it possible to obtain the copy of I-140 thru FOIA (Freedom of Information Act)?

I have my H1B visa with NIIT. My petition and visa for the first 3 yr period expire in October 2008. I am returning to India in April '08 to do my MBA, and will resign from NIIT, and therefore will not be able to renew my visa.

If I want to work in the US after I graduate, say in August '09, can an employer file a transfer petition based on this visa? Or Will they have to file for a new one under the quota? And if so, is there a way that I can hang on to my H1 status?
