We are getting ready to file for another H1B extension, and based on work location, will have to file with the Vermont Service Center. The employer is NOT cap-exempt, but I have had an H1B for many years (so do not need to file for new visa). I am not sure which is the correct address for filing, though. (See p. 20, I-129 instructions.) I think we need to use:
All other I-129 Cases:
USCIS
Vermont Service Center
ATTN: I-129
75 Lower Welden Street
St. Albans, VT 05479-0001.
(Other option:
H-1B Cap Cases:
USCIS
Vermont Service center
ATTN: H-1B Cap

Hi All,
My OPT expires on March 20th 2012. According to USCIS rules, I am on valid F-1 status 2 months after OPT expiration. "nonimmigrant F�1 students on post-completion OPT maintain valid F�1 status until the expiration of the OPT period and the subsequent 60-day departure preparation period".
Is it possible for me to take advantage to cap-gap after expiration of OPT as I will still be on valid status? Can I quit work for 10 days after my OPT expiration and start working again on April 1st after a employer files my H-1?
Please advise.

I'm in the 8th year of H1-B, BEC priority date 04/2001, just got a notice that the case was closed ?? and the lawyer is working to reopen the case.
I have now a very good opportunity to work for another company, huge pay and benefits, a lot of pressure from this company to work for them.
Pls who can answer 2 small questions:
1. Do I have a chance to work for this company?
2. It makes a difference if I'm currently in NJ and this new company is in Utah - thinking that maybe they are not so many applicants in that state? Just for the LC processing speed?

Hi,
ur wife's parents can write an affidavit stating the petname alias realname.For instance if her petname is "rani" and true name "swathi".They can write an affidavit mentioning that" rani alias swathi "is my daughter in the affidavit and get it notarised from any lawyer in india.The sample format can be obtained from ur attorney.

I am currently on H1B visa which will expire next year ie Nov2011. My employer just stated that due to economic conditions, they will not be able to file my GC.
My husbands company has already started his GC process ( his labor n I140 is done)but my name isnt on his application yet. We are waiting for the date to become current n then my name can be added on is 485 application as his dependent. His PD is Aug 08.
Basically I was interested in knowing abt future based employment GC. Has anyone done that before?
Is anyone aware of companies who would be interested in doing it. I just need to buy like max 2-3 years ....just to keep my H1B extensions going. I like my current job so really want to avoid changing it unless there r no other options left basically.

I recently received my FP appointment date, but I have to be on a conference the previous day. If everything goes well, I can arrive to my appointment without any problem.
But if my flight is delayed or cancelled I might risk being late to the appointment. My appointment is 10:00 am in the morning, are they very strict about the timing for FP appointment, or can we go a little late if we were delayed? Can you please share your experience?
Also, How early should we call in to postpone the appointment?

I think it takes a week or 10 days to get the receipt and it should have your case number
